A chapter 13 bankruptcy case is know a "wage earner's case." Only individuals and married couples may file a chapter 13 bankruptcy, and they must have regular income. In a chapter 13 case you make payments under a court-approved three or five-year plan. The amount you pay under the plan is based on your disposable income.

The primary benefit of chapter 13 is that it allows you to keep your assets (such as your residence or cars) while allowing you to catch up on missed payments. You will also be able to discharge some or all of your unsecured debts after you make all payments under your plan.

After a chapter 13 case is filed, a chapter 13 trustee will be assigned to your case. All payments under the plan are made to the trustee, typically through payroll deductions by your employer.
